Our commitments in brief:

•         We do not sell your personal information.

•         We do not share your purchase of YO products with advertisers in a way that identifies you. 

•         We ship in discreet, unbranded packaging.

•         You can ask us to access, correct or delete your information at any time.

2. Information We Collect

Information you give us:

•         Contact and order details: name, email, phone number, shipping and billing address, and the products you buy.

•         Account details: login email, password and saved addresses, if you create a customer account.

•         Payment details: handled by Shopify Payments and our other payment processors. We see only limited details, such as card type and the last four digits.

•         Communications: support tickets, emails, chat messages and survey answers.

•         Reviews: product reviews, ratings and any photos you post.

•         Marketing preferences: newsletter and SMS signups.

Information collected automatically:

•         Device and browser data: IP address, browser type, operating system and device identifiers.

•         Usage data: pages viewed, products added to cart, links clicked, and how you arrived at the Site.

•         Approximate location: city, region or country based on your IP address.

•         Cookies and similar tools: described in Section 5.

Information from others:

•         Shopify and payment providers: order, payment and fraud-check results.

•         Affiliate and partner platforms: which affiliate or partner link referred you.

•         Shipping carriers: delivery and tracking updates.

Consumer health data. Buying or browsing a home sperm test can reveal health-related information about you. We treat your purchase and browsing of YO products as consumer health data and handle it as described in Section 7.

3. How We Use Your Information

•         Process, ship and track your orders, and send order confirmations and shipping updates.

•         Process payments and prevent fraud.

•         Manage your customer account.

•         Answer questions and provide customer support.

•         Handle warranty claims, product complaints and safety reporting required of medical device companies.

•         Send newsletters, offers and texts if you have opted in.

•         Understand how visitors use the Site so we can improve it.

•         Run our affiliate program and pay commissions.

•         Comply with law and protect the rights and safety of our customers and MES.

EEA and UK visitors. We rely on performing our contract with you, your consent, our legitimate interests in running and improving our store, and compliance with legal obligations.

4. How We Share Your Information

We share personal information only with:

•         Shopify, which hosts our store and processes data on our behalf. Learn more in Shopify’s Privacy Policy.

•         Payment processors, such as Shopify Payments, Shop Pay, PayPal, Apple Pay and Google Pay, to process payments and prevent fraud.

•         Shipping carriers, such as USPS, FedEx and UPS, to deliver your order.

•         Store apps and service providers that help us run the Site, such as email and SMS tools, review apps, customer support software and analytics [ Google Analytics].

•         Affiliate platforms, such as UpPromote, to track referrals and pay commissions. We share order totals and referral codes, not what you bought or your contact details. 

•         MES affiliated companies, to help operate the store and support customers.

•         Authorities or others when required by law, or to protect rights, property or safety.

•         A buyer or successor if MES is involved in a merger, acquisition or sale of assets.

Service providers may use your information only to provide services to us.

We do not sell personal information. 

5. Cookies, Pixels and Analytics

We use cookies, Shopify’s built-in tools and similar technologies to:

• keep your cart and login working (essential cookies);
• remember your preferences; and
• understand traffic and shopping behavior through tools like Shopify Analytics and Google Analytics, loaded through Google Tag Manager (analytics cookies).

Your choices:

• Use our cookie banner to accept or decline non-essential cookies.
• We honor Global Privacy Control (GPC) signals as an opt-out of any sharing for targeted advertising.
• Block or delete cookies in your browser settings. Essential cookies are needed for checkout to work.

6. Email and Text Messages

• You can unsubscribe from marketing emails with the link in any email.
• You can stop marketing texts by replying STOP.
• We will still send messages about your orders and account.
• We do not share your phone number or SMS opt-in consent with third parties for their own marketing.

7. Consumer Health Data (Washington, Nevada and Others)

Some state laws, including Washington’s My Health My Data Act and Nevada SB 370, protect “consumer health data.” Because our products relate to reproductive health, we treat the following as consumer health data:

•  the YO products you browse, add to your cart or buy; and
• any health information you choose to share with our support team.

We collect and use this data only to sell, ship and support the products you request. We do not sell it, and we share it only with the service providers in Section 4 for those purposes. You can ask to access or delete it, or withdraw consent, by contacting us. 

8. Retention and Security

• We keep order and payment records as long as tax and accounting laws require [e.g. 7 years].
• We keep account information until you delete your account.
• We keep support and complaint records as long as FDA medical device rules require.
• We keep marketing data until you unsubscribe or ask us to delete it.

Our store runs on Shopify, which is certified PCI DSS Level 1 for payment security, and the Site uses HTTPS encryption. No online system is completely secure. If a breach affects your personal information, we will notify you as required by law.

9. Your Privacy Rights

Everyone. You may ask us to access, correct, delete or receive a copy of your personal information, or to stop marketing to you. Email support@yospermtest.com or submit a request. We will verify your identity, usually through your account or order email, and respond within 45 days. You may use an authorized agent, and we will not treat you differently for using your rights.

California residents. Under the CCPA/CPRA, you have the right to know what personal information we collect, use and disclose (Sections 2 to 4); to access, correct and delete it; to opt out of sale or sharing (we do neither); and to limit the use of sensitive personal information. Under California’s “Shine the Light” law, you may ask whether we shared personal information with third parties for their direct marketing; we do not.

Other U.S. states. Residents of Colorado, Connecticut, Virginia, Texas, Oregon and other states with privacy laws have similar rights. If we deny your request, you may appeal by replying to our response.

EEA, UK and Switzerland. You also have the right to restrict or object to processing, withdraw consent at any time, and complain to your local data protection authority.

10. International Visitors

MES is based in the United States, and Shopify stores data in the United States, Canada and other countries. If you shop from outside the United States, your information will be transferred to and processed in these countries. For transfers from the EEA, UK or Switzerland, we and Shopify rely on safeguards such as the European Commission’s Standard Contractual Clauses.

11. Children

The Site is intended for adults 18 and older. We do not knowingly collect information from anyone under 18. If you believe a minor has shared information with us, please contact us and we will delete it.

12. Changes to This Policy

We may update this Policy by posting a new version with a new “Last updated” date. If we make material changes, we will let you know by email or a notice on the Site.
