1. Voluntary Participation: You are voluntarily opting in to share your YO Home Sperm Test results — including sperm concentration, motility, progressive motility, MSC, PMSC, and your test video — with Sperm Racing, a third-party organization unaffiliated with the YO Home Sperm Test product, or the manufacturer Medical Electronic Systems (“MES”).

2. Leaderboard Inclusion: Your data will be used by Sperm Racing to compile a public leaderboard, support gamified competitions, and power community engagement. Once shared, your results may no longer be considered private.

3. HIPAA Disclosure: Once your data is shared with Sperm Racing, it will no longer be protected under the U.S. Health Insurance Portability and Accountability Act (HIPAA) or treated as confidential medical information.

4. Personal Information Disclosure: You consent to share your name and other personal information (such as email address or user-submitted profile details) with Sperm Racing. This information may be displayed or used in conjunction with your test results for leaderboard, marketing, or contact purposes.

5. Digital Storage: You understand that your data, including test results and personal information, will be stored digitally and transmitted through internet-connected systems. This information may reside on third-party
servers and cloud infrastructure, both in and outside the United States.

6. Marketing Use and Contact: Your results and submitted information may be used by Sperm Racing for marketing and promotional purposes, including public or social media campaigns, and you may be contacted directly by Sperm Racing via the contact information you provide.

7. Responsibility of Use: MES is not responsible for how Sperm Racing stores, processes, publishes, or uses your data once shared.

8. Age and Identity: You confirm that you are over 18 years old and are the individual who provided the semen sample.

9. Revoking Consent: You may revoke this consent at any time by sending an email to: privacy@yospermtest.com with the subject line “Revoke Sperm Racing Consent.” Please note that any data already shared or published may not be retractable.

10. No Liability: MES shall not be liable for any third-party use, misuse, or disclosure of your data once it is shared based on your consent.

By submitting your results, you agree to share your YO Home Sperm Test results with Sperm Racing and understand that your data may be used for leaderboard, marketing, and contact purposes.
